Frankencart — Terms of Service

1. Who these terms are between

2. What Frankencart actually is

Frankencart is a tool that runs on your device. It emulates cartridge-based video game hardware in your browser, and it can combine or modify game files that you supply from your own device.

3. Your responsibilities regarding game files

You are solely responsible for every file you load into the Service. By loading a file you represent that you have the lawful right to possess and use it — for example because you own the original cartridge, or the work is public domain, or you hold a licence or other permission.

You must not use the Service with files you have no right to use. We have no way to inspect what you load and we do not attempt to, so this obligation rests entirely with you.

We do not provide, host, link to, index, or help you find game files, and requests for them will not be answered.

4. Acceptable use

Detailed rules are in [ACCEPTABLE-USE.md](./ACCEPTABLE-USE.md), which forms part of these terms. In summary, do not use the Service to infringe copyright, to distribute game files to others, to harass anyone, to cheat competitive features, or to attack or disrupt the Service.

5. Discord

The Activity and the bot run inside Discord. Your use of Discord is governed by Discord's own Terms of Service and Privacy Policy, which are separate from ours and which we do not control. Discord may process data about your use of the Activity independently of us — see [PRIVACY.md](./PRIVACY.md).

You must be old enough to hold a Discord account in your country, and in no case under 13. If you are under the age of majority where you live, you may use the Service only with the involvement of a parent or guardian.

8. Availability, and changes to the Service

The Service is provided on an "as available" basis. We may change, suspend, or discontinue any part of it — including competitive features and stored results — at any time. We will try to give notice of significant changes, but we do not promise uninterrupted availability, and this is a hobbyist project rather than a commercial service with an uptime commitment.

9. Our intellectual property, and third-party components

The Frankencart name, site, documentation and original source code are ours or our licensors'. The Service also incorporates third-party open-source components, including the EmulatorJS engine and libretro-derived emulator cores, each under its own licence; those licences govern those components and nothing here overrides them.

Nothing in the Service grants you rights in anyone's game titles, characters, or artwork. Those belong to their respective owners, and no affiliation with or endorsement by any of them is claimed or implied.

10. Disclaimer of warranties

To the fullest extent permitted by law, the Service is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

Emulation and file modification are inherently imperfect. We do not warrant that any particular file will work, that a modified file will be playable or completable, or that the Service will not corrupt data. Keep your own backups of anything you care about.

11. Limitation of liability

To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential, or exemplary damages, or for lost data, lost profits, or loss of goodwill, arising from your use of the Service.

Our total aggregate liability arising out of or relating to the Service will not exceed the greater of [AMOUNT, e.g. USD 100] or the amount you paid us in the twelve months before the claim.

Some jurisdictions do not allow certain exclusions or limitations, so parts of this section may not apply to you; nothing here limits liability that cannot lawfully be limited, including for fraud, death, or personal injury caused by negligence.

You agree to indemnify us against claims, damages, and reasonable costs arising from your misuse of the Service or your breach of these terms — in particular any claim arising from files you loaded into it.

If you believe something we actually host infringes your rights, see [DMCA.md](./DMCA.md) for how to contact us and what we will do.

Note that user-supplied game files are never transmitted to or stored on our systems, so they are not something we can remove; our notice-and-takedown process applies to content we host.

14. Termination

You may stop using the Service at any time. We may suspend or terminate your access if you breach these terms or the Acceptable Use Policy, or where we must do so to comply with law. Sections that by their nature should survive termination — ownership, disclaimers, liability, indemnity, governing law — do survive.

15. Changes to these terms

We may update these terms. The version number and "last updated" date at the top will change, and material changes will be announced in the Frankencart Discord. Continuing to use the Service after a change means you accept the updated terms.

16. Governing law and disputes

These terms are governed by the laws of [JURISDICTION — e.g. State of X, USA], without regard to conflict-of-law rules. Disputes will be brought in the courts of [VENUE], and both parties consent to that venue.
